Overview
The Australian Council for Educational Research Ltd (“ ACER Ltd”, “we”, “us” or “our”) located in Australia is committed to protecting the privacy of personal information (i.e. any information relating to an identified or identifiable natural person) who visit: Teacher Jobs (https://jobs.teachermagazine.com) (the “Site”) and use the services available thereon which are to provide schools and organisations with a site to advertise positions of employment and provide the necessary information for prospective applicants to apply directly to the schools and organisations for those positions. ACER Ltd will not be processing any of your personal information for the purpose of such applications (the “Services”).
There will be two classes of Users of the Site:
1. Prospective applicants - in which case ACER Ltd will only collect aggregated information generated by our systems (or third party systems) to track Site traffic that does not identify you personally;
2. Employers - personal information about you such as your name, address, telephone and facsimile number, email address and in some cases, your billing details and general financial and credit information and such information as may be necessary or appropriate in connection with the provision of, or notifying you about, the Services You will also be asked to create a username and private password, which will become part of your account information
Amendments to this Privacy Statement will be posted to the Site and/or Services and will be effective when posted. Your continued use of the Site and/or Services following the posting of any amendment to this Privacy Policy shall constitute your acceptance of such amendment.
When you register as an employer of our Site and Services, we ask for personal information that will be used to activate your account, provide the Services to you, communicate with you about the status of your account, and for other purposes set out in this Privacy Statement. Your name, company name, address, telephone number, email address, credit card information and certain other information about you may be required by us to provide the Services or be disclosed by you during your use of the Services.
The only consequence of not providing such personal information is that ACER Ltd may not be able to provide the Services to you.
We take steps designed to ensure that only those ACER Ltd employees who need access to your personal information to fulfil their employment duties will have access to it. We may use and disclose your personal or account information for the following purposes, to:
· provide the Site and Services to you and to other users of the Site and Services;
· create, manage and control your account information, and to verify access rights to the Site and Services;
· bill your account;
· communicate with you (subject to your opt-out rights set forth in this Privacy Statement), including without limitation for the purpose of providing you with information about the Services, or informing you of changes or additions to the Services or of the availability of any other services or features we provide;
· assess service levels, monitor traffic patterns and gauge popularity of different features and service options of the Site and/or Services;
· enforce this Privacy Statement or our Terms of Service;
· protect against fraud or error, and to respond to claims of any violation of our rights or those of any third parties;
· respond to your requests for customer service;
· protect the rights, property or personal safety of you, us, our users and the public; and As required, comply with applicable laws or as authorized by applicable laws. For the purposes of billing your account (if you have a paid account) and in order to process payments, ACER utilises third party payment gateways, such as Stripe, who will utilise your credit card and other payment information in accordance with their respective privacy policies.
Such disclosure may be to ACER contractors which may assist ACER from time to time with providing the Services and maintaining the Site.
Transfer out of Australia
The Site is hosted by MktCo LLC trading as NiceBoard located in the USA. Please see NiceBoards’s privacy policy at https://niceboard.co/privacy. When employers register for use their personal information will be stored in the USA.
ACER takes seriously the protection of personal information. ACER will abide by the Privacy Act 1988 (Cth) ('the Act').
Under the Australian Privacy Principles contained in the Act ACER is bound to take steps, reasonable in the circumstances, to ensure any overseas entity it transfers your personal information to complies with the Australian Privacy Principles.
BUT IF YOU CONSENT to such disclosure, ACER will not have to take steps to ensure compliance by the entity with the Australian Privacy Principles.
THE CONSEQUENCES OF GIVING SUCH CONSENT ARE:
1. the country of the entity may not have similar privacy laws or measures by which you may pursue any of your rights in respect of privacy as that of Australia;
2. the entity may not handle your personal information in the manner designated under the Australian Privacy Principles and you may not have any mechanism with which to seek redress.
By using the Services, YOU CONSENT to the transfer of information to countries outside your country of residence, which may have different data protection rules than in your country. 1. inspect your personal information;
2. request amendment of your personal information; and
3. make complaint in respect of a breach of your privacy.
